DentalMarket — Terms of Service

1. Acceptance of These Terms

By creating an account, browsing listings, or otherwise using the DentalMarket mobile application ("DentalMarket," "we," "us," or "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

2. What DentalMarket Is

DentalMarket is a mobile marketplace where dental professionals can list, buy, and sell used dental devices and equipment. DentalMarket is an intermediary: we facilitate listings, manually verify buyer payments, and coordinate delivery — but we are not the buyer, the seller, or a party to the underlying sale of any item.

3. Who Can Use DentalMarket

DentalMarket is intended for dentists and dental professionals. By registering an account, you represent that you are using the Service for a legitimate professional or personal purpose related to buying or selling dental equipment, and that all information you provide is accurate. We do not currently verify professional licensure, and creating an account does not certify that you hold any particular credential.

You must be able to form a legally binding contract to use DentalMarket. If you are using the Service on behalf of a clinic or business, you confirm you have the authority to bind that entity to these Terms.

4. Browsing, Accounts, and Verification

• Guest browsing. You can browse listings, search, and view product details without creating an account.
• Creating an account. Certain actions — adding an item to your cart, messaging a seller, posting a listing, checking out, and others — require a registered account (email/password or Google Sign-In).
• Email verification. To post or edit a listing, or to complete a purchase, your account email must be verified. This helps ensure that people transacting real money on the platform are reachable and accountable.
• Account security. You are responsible for keeping your login credentials confidential and for all activity under your account.

5. Listing an Item (Sellers)

• When you list an item, you choose whether you will personally deliver it to the buyer, or whether DentalMarket will arrange delivery on your behalf (see Section 8, Fees).
• You are solely responsible for the accuracy of your listing — condition, description, photos, category, and price. Listings must not include prohibited items (see Section 11) or attempts to share direct contact information with buyers before a sale is completed (see Section 11).
• Once an item sells, it is marked unavailable and cannot be purchased by anyone else.
• You are responsible for having the legal right to sell the item listed.

6. Buying an Item

• Adding an item to your cart requires a signed-in account.
• At checkout, you provide (or confirm) a delivery address and contact phone number for that order — this is required regardless of who delivers the item.
• You may optionally opt into a Buyer Safety Fee on a per-item basis (see Section 8).
• After placing an order, you are prompted to pay the amount due via a supported manual payment method (currently QiCard or ZainCash) and to submit your payment reference/transaction number through the app.
• Payment is verified manually by DentalMarket staff. Your order will show as "Awaiting Payment" until this is confirmed.

7. How Delivery Works

• If the seller chose to deliver the item themselves, you (the buyer) confirm receipt in the app once the item arrives.
• If DentalMarket is handling delivery, DentalMarket staff will update the order status through pickup and delivery.
• Once payment is verified, and only for orders where the seller is delivering, the seller receives your delivery name, address, and phone number through the app, solely to complete delivery. DentalMarket does not guarantee delivery timeframes.

8. Fees

DentalMarket charges the following fees, which may be changed from time to time (changes apply only to orders placed after the change — orders already placed keep the rate that applied at checkout):

• Sale Commission — a percentage of the sale price, deducted from the amount paid out to the seller.
• Delivery Fee — if the seller chooses to have DentalMarket handle delivery, a fee is deducted from that seller's payout. There is no delivery fee if the seller delivers the item themselves. This fee is never charged to the buyer.
• Buyer Safety Fee — a small, flat, optional fee a buyer may choose to add per item at checkout. This fee is never shared with the seller.

Sellers are paid out, minus applicable fees, after payment is verified and the order is confirmed delivered — unless an open dispute is blocking that order (see Section 10).

9. Order Cancellations

Once a listing is purchased, it is marked sold and removed from active browsing. DentalMarket does not currently offer an automated cancellation feature. If you need to cancel an order before payment is verified, contact us using the details in Section 16.

10. Disputes

If you are a buyer and believe an order was not delivered, or was materially different from its listing, you may file a dispute from that order's detail page once your payment has been verified. Filing a dispute:

• Pauses the seller's payout on that order until DentalMarket resolves it.
• Notifies the seller that a dispute exists (without disclosing your specific complaint text to them).

DentalMarket will review disputes and resolve them manually — in the buyer's favor, in the seller's favor, or by dismissing the dispute — based on the information available. DentalMarket does not automatically process refunds; any refund is arranged manually between DentalMarket and the affected party outside of the standard payout flow.

11. Prohibited Conduct

You agree not to:

• Attempt to share phone numbers, email addresses, or other direct contact information with another user before a purchase is completed, in order to arrange a sale outside the app.
• List counterfeit, stolen, illegal, or otherwise prohibited items.
• Submit a false payment reference, impersonate another user, or otherwise attempt to defraud DentalMarket or another user.
• Use the Service if you are not able to form a binding contract, or if you have been previously suspended or removed from DentalMarket.
• Attempt to interfere with, disable, or circumvent any security feature of the Service.

DentalMarket uses automated filtering (covering both English and Iraqi Arabic) to detect attempts to share contact information in messages before a sale, as an additional layer on top of this policy.

12. Reporting Listings

If you believe a listing is fraudulent, misleading, or otherwise inappropriate, you can report it from the listing's page. Reports are reviewed by DentalMarket staff. Reporting is limited to one report per listing per user, and is intended for genuine concerns, not repeated or bad-faith use.

13. Ratings and Reviews

Buyers and sellers may leave ratings/reviews related to completed transactions. Reviews must reflect a genuine transaction experience and must not contain contact information, harassment, or unrelated content.

14. Content You Submit

You retain ownership of the photos, descriptions, and other content you submit to DentalMarket. By posting content, you grant DentalMarket a license to display, store, and distribute that content as needed to operate the Service (for example, showing your listing photo to other users).

15. Disclaimers

DentalMarket provides the Service "as is." We do not inspect items before they are listed and cannot guarantee the condition, safety, authenticity, or fitness for any particular purpose of any item listed by a user. Transactions occur between individual buyers and sellers; DentalMarket facilitates payment verification and delivery coordination but is not a party to the sale itself.

16. Limitation of Liability

To the maximum extent permitted by law, DentalMarket and its owner/operators are not liable for indirect, incidental, or consequential damages arising from your use of the Service, or from any transaction between users, beyond the fees actually paid to DentalMarket for that transaction.

17. Suspension and Termination

DentalMarket may suspend or terminate an account that violates these Terms, including for fraud, repeated policy violations, or attempts to circumvent the platform's payment or anti-contact-sharing protections. You may stop using the Service and request account deletion at any time (see our Privacy Policy).

18. Governing Law

These Terms are governed by the laws of the Republic of Iraq, without regard to conflict-of-law principles, unless otherwise required by applicable local law.

19. Changes to These Terms

We may update these Terms from time to time. Continued use of DentalMarket after a change takes effect constitutes acceptance of the updated Terms. We will indicate the effective date of the current version at the top of this document.
